Privacy Policy & Security Statement
This privacy policy covers the collection and use of personal information that may be collected by us anytime you interact with LMI Group, such as when you visit our website or one of our offices, when you purchase LMI Group (online/manual) products and services, or when you call our technical advisers, and extends to our representatives. Please take a moment to read the following to learn more about our information practices, including what type of information is gathered, how the information is used and for what purposes, to whom we disclose the information, and how we safeguard your personal information. Our privacy policy also deals with how you can complain about a breach of the privacy laws, access the personal information we hold about you and have that information corrected (where necessary). 1.General
1.1. LMI Group is committed to ensuring your privacy and understands your concerns regarding the confidentiality and security of personal information you provide to us. LMI Group’s privacy policy complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) set out in the Act.
1.2. To the extent that LMI Group’s services extend to Europe/the UK, we comply with the relevant laws including the EU’s General Data Protection Regulations concerning the privacy and protection of data and the lawful processing of data that is personal, which includes collecting, restricting, destruction, and erasing personal data.
2.Collection of Personal Information
2.1. There are a number of situations in which your personal information is collected to help us give you better service. For example, we may ask for your personal information when you’re discussing a loss management or risk assessment issue on the phone or face-to-face with a technical adviser, downloading an online subscription service or software update, registering for a training module, discussing and/or arranging your insurance requirements, participating in a survey or purchasing a business publication. At such times, the information we may collect includes:
2.1.1. your name, business address, ABN, home address, phone numbers, fax numbers, email address and in some cases your credit card number and contact preferences;
2.1.2. your occupation/job role function, insurance/risk management information and information about the levels of covers you have, such as their policy numbers, insurers, excesses, security provisions, levels of gross profit and assets, extent of loss or damage and/or nature of injury sustained;
2.1.3. information such as renewal dates, current premiums and details of previous claims history and financing arrangements; and
2.1.4. details of financials may be needed to calculate the cost of your loss and assess claims.
2.2. By providing LMI Group with your personal information you consent to its use for the following purposes:
2.2.1. analysing your needs;
2.2.2. fulfilling your orders;
2.2.3. delivering products and services to you;
2.2.4. managing and enhancing LMI Group customer data;
2.2.5. providing customer service;
2.2.6. assessing your interest in our products and services, or conducting customer research or satisfaction surveys in order improve our products and services; and
2.2.7. developing and improving our products and services.
2.3. In addition, your information allows us to send you direct marketing communications including announcements, software updates, special offers, and training events that you might like to hear about. We always give you the option of electing not to receive such notifications, so please contact us if you do not wish to receive them.
2.4. We may also collect your information from third parties such as your insurer, broker or loss adjuster.
3. Failure to Provide Information
3.1. We collect and use your personal information in order to provide you with information on financial products and services. In the absence of correct information or if you do not give us the information that we request LMI Group may be unable to determine which product or service is appropriate for your needs
4. Use & Disclosure of Personal Information
4.1. We cannot guarantee the privacy of personal information you transmit over the web or that it may be collected in transit by others, including contractors who provide services to us.
4.2. However, be assured that LMI Group does not sell or rent your contact information to other marketers and we will never give your information to an outside organisation, unless we need to in order to assist you (as outlined in this privacy policy), or it is required by law, or if we determine that for national security, law enforcement, or other issues of public importance, disclosure is necessary.
4.3. LMI Group are a global organisation and for the purposes set out above we may transfer your personal information to parties located in other countries (including countries that have a different data protection regime than is found in Australia). Any data we collect will be shared, if appropriate, with any of the offices of LMI Group throughout the world, including the United States, Europe and Asia and any third parties who provide services on our behalf. If this is likely to happen, we will inform you beforehand if it is possible to do so.
4.4. The information we collect may be provided to organisations if we are required to assist you, such as with a claim or insurance policy, and these organisations could include:
4.4.1. insurers/reinsurers;
4.4.2. insurance advisers;
4.4.3. lawyers;
4.4.4. assessors;
4.4.5. repairers;
4.4.6. advisers (including engineers, architects and other professional advisers);
4.4.7. loss adjusters; and
4.4.8. accountants.
4.5. If information is provided to overseas organisations (including LMI Group offices located outside Australia), we will take reasonable steps to inform you beforehand and to ensure that they protect your information as required under the Privacy Act, the APPs and (if appropriate) the EU’s General Data Protection Regulations
4.6. LMI Group may use PayPal, eway or other payment gateways for online transactions. These sites are subject to their own terms and conditions contained in their respective agreements of use.
4.7. If you provide personal information about another person to LMI Group or one of the organisations assisting it, you must have that person’s authorisation to provide their information and you must inform that person of LMI Group’s identity and how it will use and disclose the information and that person’s rights to access that information.
5. Security
5.1. LMI Group takes precautions (including administrative, technical, and physical measures) to safeguard your personal information against loss, theft, and misuse, as well as unauthorised access, disclosure, alteration, and destruction. We keep personal information for as long as reasonably necessary for the purpose it was collected or to comply with any applicable legal reporting or document retention requirements. We may hold the information we collect from you using different methods, such as in our computer system and in our hard copy files. Our security procedures comply with the regulatory guidelines. In some cases, your personal information may be included in our office files and these may be archived and sent to an external data storage provider for a period of time. We only use storage providers located in Australia who are also regulated by the Privacy Act.
6. Collection of Information by Third-Party Sites and Sponsors
6.1. Where another website is linked on our website, LMI Group does not warrant that the site complies with its legal obligations regarding privacy and accessing the site is at the user’s risk in respect of such matters as bugs, inaccuracies, viruses, and the content on the site. Visitors should consult the other sites’ privacy notices as we have no control over information that is submitted to, or collected by, these third parties.
7.Access & Correction
7.1. LMI Group will take reasonable steps to make sure that the personal information we collect, use or disclose is accurate, complete and up to date for the purposes for which it is used. You can access your personal information that LMI Group holds and correct the details you have provided at no charge. 7.2. In some limited cases, we may need to refuse access to your information or refuse a request for correction. We will advise you as soon as possible after your request if this is the case and the reasons for our refusal.
8. LMI Group’s Website, Use of Cookies & Other Technologies
8.1. LMI Group websites implement SSL certificates which encrypt information sent between you and our websites. This is a security measure designed to make it very difficult for anyone to intercept that information.
8.2. LMI Group websites also make use of cookies. Cookies are very small text files that a website can transfer to your computer’s hard drive for record keeping. Cookies can make using our website easier by storing information about your preferences and enabling you to take full advantage of our services.
8.3. Most Internet web browsers are pre-set to accept cookies to enable full use of websites that employ them.
